 For the very reason I mentioned:

The shinigami by the leg has a ragged haori. Ken-chan has the ragged haori, not Byakuya. And besides, why would Byakuya slice the leg if he'd just used kido? Doesn't that suggest he wants to remain at a distance, i.e. use his shikai at least.

Also, by Ken-chan saying "attack FIRST" it could imply that the SECOND attack (i.e. the leg cutting off) was not Byakuya.

Wouldn't be so sure about that dude..

You can clearly see the ragged clothes from Kenpachi and watch how Yammy turns around saying "What!?".. Kenpachi is pissed cause he threw that Kidou on him to begin with, see?

I agree that Byakya fired the first shot - knocking Yammi aside and taking his attention off Ichigo. However, I believe Zaraki was the one who got the leg - he was mad Byakya fired off the first shot... I just enjoyed watching Yammi get the smack down... (not a yammi fan) An aside.. Byakya seems way more effeminate in the manga than the anime..
